This agreement between Tracey
Semchison, ( Breeder)
and (Buyer).
l) Buyer agrees and
binds him/herself to take good and reasonable care of this cat/kitten so as
to provide food, shelter, correct routine and accident related medical care,
exercise and affection. It is agreed that this animal will not be
allowed outside without supervision. Abuse, neglect or lack of
adequate care will result in Buyer relinquishing cat/kitten to breeder
unconditionally.
The Kitten/Cat has received
the following vaccinations:
The Kitten/Cat has received the following deworming: Give
only 3 or 4 way Killed vaccine or the newer modified live vaccines
that offer the least risk of vaccination site sarcomas and allergic
reactions. Giving Feline Leukemia
vaccine, or FIP vaccines may result in guarantee being void.
These vaccines are more risk than help to indoor only cats in low risk
situations. Guarantee is void
if kitten is de-clawed or
has been allowed out unsupervised.
2) Litter Registration will be
furnished upon receipt of proof of spay/neuter in the case of kittens sold
as PETS. This agreement acknowledges that the buyer of any animal
purchased as a “PET” is to be spayed or neutered before 7 months of age
and is NOT to be used for breeding purposes or it will be required that the
cat be surrendered to the breeder to be altered at the owners expense.
Offspring resulting from breedings of a kitten sold as a “pet”
belong to the Breeder and will be surrendered unconditionally. In some
cases breeding rights may be purchased by the Buyer upon paying the Breeder
the difference between Pet and Breeder Value (currently $l500 -
$2500+/with/without a pick
kitten back). This is only in the case of breeding/show quality
kittens that are sold as pets that do not display any major faults or
defects from the Bengal/Pixie-Bob Standards for use in a purebred Bengal/Pixie-Bob breeding
program. A separate Guarantee and Agreement would have to be signed
pertaining to Breeding/Show quality animals before full breeding rights and
unlimited registration papers would be given. See

3) Said kitten/cat is in good health and has been examined by a veterinarian. Kitten/Cat is guaranteed free from
communicable diseases for a period of 72 hours from the date of sale.
Kittens are not guaranteed against accidental death or injury at any time
after sale. Please isolate any new addition to a multi-cat household for a
period of time. Please have this kitten examined by your veterinarian as
soon as possible so you are both confident that the kitten is completely
healthy. If the kitten is found deficient in any way it can be
returned to the Breeder within 5 days for a) a full refund, b) treatment for the
deficiency, or c) a replacement kitten of equal quality and value. Breeder
can not be responsible for contagious diseases the kitten is exposed to
during shipping that are not evident during the initial guarantee
period. No refunds will be given after 72 hours. Kittens/cats that have been
in contact with other kittens/cats will be quarantined upon arrival back to
our cattery,
with blood testing being done at Buyers expense to ensure they have not been
in contact with diseases. The cost of this testing will be
deducted from any refund. Very specific instructions are included with
the kitten as to diet, litter used and how to socialize a new kitten/cat
into a new household. Breeder can not be responsible for results from
failure to follow these instructions. Kittens are not guaranteed
to be hypoallergenic - please test for allergies before getting a kitten if
you are unsure. 20% of purchase price will be held back on kittens
returned and subsequently re-sold due to allergies. Other deductions
may apply, see above.
4) Said kitten/cat is
further guaranteed to be free from congenital defects or genetic diseases
for a period of two years from date of sale. In the event that
this kitten is found to have a congenital defect or genetic disease that
interferes with its' intended purpose or requires medical treatment:
a) it
can be returned to the breeder for a replacement of equal
quality.
b) it can be kept by the
owner, and upon proof of spay/neuter a credit will be issued for 50% -
l00% of the purchase price to be used at any time in the future towards
the purchase of another kitten/cat. Percentage to be determined by
severity of condition, expense of treatment if any, etc.
c) if euthanasia is
considered to be necessary or imminent, a replacement kitten will be
given. NO KITTEN OR CAT IS TO BE EUTHANISED WITHOUT THE PRIOR KNOWLEDGE OF THE
BREEDER, EXCEPT IN THE CASE WHERE
A VETERINARIAN CONSIDERS IT THE ONLY HUMANE ALTERNATIVE, OR THE
GUARANTEE IS VOID. An autopsy is required to confirm a medical
diagnosis in this case.
d) if a pet is
diagnosed with a minor imperfection (not known at time of sale) that requires no treatment and does not interfere with the normal
function and purpose of the cat as an active pet, then no credit will be
given.
e) Where a replacement or credit is requested or where euthanasia
is requested, buyer agrees to grant full access to all
veterinary records to Breeder. Veterinary records include
copies of actual visit cards to veterinarians stating vaccinations,
injuries, test results, etc. during the period the kitten is owned by the
Buyer. No refund or replacement will
be given for any condition or defect caused by accident, neglect or
malnutrition. Buyer is responsible to provide immediate veterinary
care to any kitten/cat showing signs of illness or distress. Failure
to do so will render this guarantee null and void.
BREEDER
ASSUMES NO LIABILITY FOR VETERINARY COSTS OR OTHER EXPENSES INCURRED BY
THE OWNER. BUYER ACKNOWLEDGES THAT BREEDERS LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND
AGREEMENT AND IS LIMITED TO PHYSICAL REPLACEMENT OF KITTENS/CATS.
PET HEALTH INSURANCE IS HIGHLY RECOMMENDED AND EASILY AVAILABLE.
5) Should it become
necessary for any reason to part with this kitten/cat, the Buyer agrees to
give the Breeder first opportunity to relocate the cat at no expense
to the Owner. Breeder agrees to find another home for the cat if for
any reason the Buyer can not keep it to avoid the possibility of any cat
being placed in temporary homes or shelters.
6) Replacement kittens to be
of same quality as originally purchased unless other arrangements are made
between the two parties. Credits or replacement kittens to be granted
within 6 months from proof of spay/neuter of affected animal, return of
affected animal, or release of medical records of affected
animal.
Please be sure to read and
understand this Agreement before signing. I would be happy to discuss
any part of it or to answer any questions. This Contract is legally
binding to all parties involved. Venue is the Front of Leeds and
Lansdowne, Ontario, Canada.
