1) Buyer agrees and binds
him/herself to take good and reasonable care of this cat/kitten so as to
provide food, shelter, correct routine and accident related medical care,
exercise and affection. It is agreed that this animal will not be
allowed outside without supervision. Abuse, neglect or lack of
adequate care will result in Buyer relinquishing cat/kitten to breeder
unconditionally. Buyer acknowledges that they are not affiliated in
any way with a Pet Store, Animal Broker or Agent. Kittens will be
housed in homes or in adequate facilities to allow sufficient exercise for
an active healthy physical and mental existence.

2) This animal is a purebred Bengal
Cat or Pixie-Bob and the four generation pedigree provided is the correct breeding of
same.
3) Registration will be furnished as
soon as is feasible in the case of BREEDER/SHOW quality kittens or upon
completion of all terms, payments, kittens back, etc. The following
terms apply to this

4) Said kitten/cat is in good health and is guaranteed free from
communicable diseases for a period of 72 hours from the date of sale.
Kittens are not guaranteed against accidental death or injury at any time
after sale. It is considered common cattery practice and good animal
husbandry to isolate any new addition to a multi-cat household for a
period of time. Please have this kitten examined by your veterinarian as
soon as possible so you are both confident that the kitten is completely
healthy. If the kitten is found deficient in any way it can be
returned to the Breeder within 5 days for a) a full refund, b) treatment for the
deficiency, or c) a replacement kitten of equal quality and value.
Breeder can not be responsible for contagious diseases the kitten is exposed
to during shipping that are not evident during the initial guarantee period.
5) Said kitten/cat is further
guaranteed to be free from congenital defects or genetic diseases for a
period of two years from date of sale. In the event that this
kitten is found to have a congenital defect or genetic disease that will
interfere with its' intended purpose (showing or breeding):
a) it can be returned
to the breeder for a replacement of equal quality (breeder/show)
b) if the
owner wishes to keep the kitten as a pet, and Breeder does not wish it back,
it can be kept by
the owner, and upon proof of spay/neuter a credit will be issued to reduce
the price of the cat/kitten to 50% of average pet price (pet price to
be determined based on the original value of the kitten and the defect
involved) This credit can be used towards another kitten of
equal or better value.
c) if euthanasia is
considered to be necessary or imminent, a replacement kitten will be given.
NO KITTEN OR CAT IS TO BE EUTHANISED WITHOUT THE PRIOR KNOWLEDGE OF THE BREEDER, EXCEPT IN THE CASE WHERE
A VETERINARIAN CONSIDERS IT THE ONLY HUMANE ALTERNATIVE, OR THE
GUARANTEE IS VOID.
d) if a cat/kitten is
diagnosed with a minor imperfection (not known at time of sale) that
requires no treatment and does not interfere with the normal function
and purpose of the cat, then no credit will be given.
e) in the case of
breeding and show quality animals where a defect or disease interferes with the intended purpose of the
cat the options a) or b) apply. In the case of lockets or tail faults
that become evident as the kitten matures, the breeder has the right to ask
for the return of the kitten and a replacement given if the owner does not
wish to keep the kitten as a pet. No refund or replacement will be given for any cat that
has been bred or produced a litter, purebred or otherwise unless the said defect involves
congenital defects of the kittens determined by test breedings to more than one mate, or a
condition in the parent that is only discovered after the birth of a
litter(s) and could result in liability on the part
of the buyer with respect to the kittens sold that may also carry the said
defect.
BREEDER ASSUMES NO LIABILITY FOR
VETERINARY COSTS OR OTHER EXPENSES INCURRED BY THE OWNER. BUYER
ACKNOWLEDGES THAT BREEDERS LIABILITY CAN NEVER EXCEED WHAT IS EXPRESSED IN THIS GUARANTEE AND
AGREEMENT AND IS LIMITED TO PHYSICAL REPLACEMENT OF KITTENS/CATS. NO
REFUNDS ARE GIVEN AFTER 5 DAYS.
f) Where a replacement or credit is requested or where euthanasia
is requested, buyer agrees to grant full access to all veterinary
records to Breeder. Veterinary records include copies of actual
visit cards to veterinarians stating vaccinations, injuries, test results,
etc. during the period the kitten is owned by the Buyer. No refund or replacement will be
given for any condition or defect caused by
accident, neglect or malnutrition. Buyer is responsible to provide
immediate veterinary care to any kitten/cat showing signs of illness or
distress. Failure to do so will render this guarantee null and void.
6) If a BREEDING/SHOW quality
animal, it is agreed that no kittens from said cat will be sold to pet dealers, pet shops or their agents. No
male kittens from said cat will be sold without restricted registrations
(to be altered) unless otherwise agreed to with Breeder in writing. If purchased
cat/kitten is a whole male, it is agreed that he will not be leased or sent
away from his home to provide stud service or be bred to any outside females
not fully tested for feline infectious diseases. This male must be
neutered when Buyer is finished using him for his personal use for breeding
and may not be sold to another party as a breeding animal unless otherwise
agreed to in writing.
7) Should it become necessary for
any reason to part with this kitten/cat, the buyer agrees to give the Breeder first opportunity to repurchase at
a price not higher than that offered to any other party. Buyer may at his option neuter/spay this cat and not offer
him back to Breeder.
8) If a kitten is designated as a SHOW/BREEDING potential animal and
before it is used for breeding exhibits any major illness or hereditary
defect that
should eliminate it from a responsible breeding program, the Breeder retains the right
to provide a replacement kitten upon proof of spay/neuter of affected kitten/cat.
If a
kitten is designated as a SHOW or BREEDING potential this means the kitten has been determined
by the Breeder to possess qualities or pedigree above and beyond the definition of a
PET. This animal is purebred, registerable and is free from all disqualifying faults at the
time of sale. A "SHOW" QUALITY KITTEN IS GUARANTEED to be able to obtain a minimum of a CHAMPIONSHIP Title
at either CCA or TICA shows, with the following conditions:
a) kitten
MUST be shown as a kitten (4 - 9 months) in at least 4 separate shows (2 weekends).
b) must be
shown between 9 - 12 months of age in at least 4 separate shows (2
weekends). If the cat does not obtain the championship within
a reasonable time of fulfilling the above requirements: Breeder is to be given option
to show and obtain the title on behalf of the Buyer. If title is still unobtainable,
Breeder agrees to replace the cat upon return of original cat to breeder with another SHOW potential kitten.
Other arrangements might also include credit the difference between a show
quality and BREEDER quality kitten if Buyer has used cat in a breeding
program, or provide credit for 50% towards the purchase of a new SHOW
quality kitten, or upon proof of spay/neuter of said kitten to grant a
credit equal to the price of a replacement show quality kitten less l/2 the
value of a pet kitten - above to be discussed and determined between
Buyer and Breeder.
9) SBT generation cats are
guaranteed to be fertile as adults, given sufficient time and opportunity.
It is agreed that females will not be bred earlier than l0 months of age and
preferably not earlier than one year. Females WILL be bred earlier
than l8 months of age and no later than their third heat cycle.
Females will not be bred more often than twice per year for a spacing of at
least 6 months between litters, preferably 8.
l0) Replacement kittens to be of same
quality as originally purchased, carry no guarantee other than initial health and congenital defect.
Replacement kittens or credits to be granted within six months from proof of
spay/neuter of effected animal/return of effected
animal/or release of medical records of effected animal, etc.

Contract is legally binding to all parties involved. Venue is the
